These terms and the service operator
These Terms govern use of Stormwater Passport. “We”, “us” and “our” mean Liam Pont, trading as Stonecode Studio in New Zealand, as the operator of Stormwater Passport. Stormwater Passport is the product and service name. “You” means the person using the service and, where applicable, the organisation on whose behalf that person acts.
By creating an account or using the service, you agree to these Terms.
What Stormwater Passport provides
Stormwater Passport provides digital tools for recording and maintaining information about privately owned stormwater infrastructure. It connects property, system, asset, requirement, inspection, maintenance, defect, document and responsibility records.
The service supports recordkeeping and operational workflows. It does not independently inspect an asset or verify that information entered by a user is complete or correct.
Accounts, organisations and permissions
You must provide accurate account information, keep credentials secure and promptly tell us about suspected unauthorised access. You are responsible for activity performed through your account unless the activity occurred because of our breach of these Terms or applicable law.
Organisation owners and administrators may manage membership and billing. Other roles have the permissions assigned through the service. You must only act for an organisation, property owner or other stakeholder where you have authority to do so. Stormwater Passport records supplied responsibility information; it does not legally determine ownership or statutory responsibility.
Customer data and infrastructure records
You and your organisation retain ownership of information, documents, photographs and other material submitted to the service. You grant us the limited rights needed to host, process, reproduce, secure and make that material available according to your instructions and the operation of the service.
You are responsible for the accuracy, quality, lawfulness and relevance of material you submit, including having authority to record personal information and share documents or evidence. Do not upload content that infringes another person’s rights or contains unnecessary sensitive personal information.
Compliance, statuses and professional advice
Stormwater Passport can calculate dates and display operational statuses based on recorded information. A status shown as current, complete, satisfied or compliant is a workflow indicator only. It is not legal, regulatory, building, engineering or council certification, and does not establish asset safety, fitness for purpose or council acceptance.
You remain responsible for identifying applicable consent conditions, legal duties, maintenance requirements and professional standards. The service is not a substitute for engineering, legal, regulatory or other specialist advice where that advice is required.
Trial, subscription and cancellation
A new organisation can begin a 30-day trial with full product access and no payment card required. Continued write access after the trial requires a Single Site, Portfolio or Large Portfolio subscription, currently starting from NZ$49 per month plus GST where applicable. Stripe handles checkout, payments and billing management.
The billing page and Stripe Customer Portal show the current subscription and cancellation details that apply to your organisation. A cancellation normally takes effect according to the billing-period information shown there. Failed or overdue payment may lead to restricted access after any grace period implemented by the service.
When an organisation no longer has an active entitlement, existing records remain available read-only rather than being deleted solely because billing stopped. Reactivation can restore permitted creation and operational actions. We may change future pricing or plans with reasonable notice; a changed price will not be charged without the notice and authority required by law and Stripe’s billing process.
Permanent-record continuity
“Permanent record” describes the service’s design goal: property and infrastructure history should persist when contractors, team members, responsible organisations or owners change. It does not mean every record is legally immutable, that information can never be corrected, or that we guarantee storage for an unlimited period in every circumstance.
Ending an account, membership or subscription does not automatically destroy legitimate infrastructure records. We may preserve, correct, restrict, export, transfer, de-identify or delete information as appropriate to the service architecture, lawful instructions, privacy obligations and the rights of affected organisations and people.
Acceptable use
You must not misuse the service. In particular, you must not:
- access records, accounts or organisations without authority;
- probe, bypass or defeat authentication, row-level security, QR tokens, share links or other access controls;
- introduce malware, interfere with availability, automate abusive traffic or attempt to extract protected data;
- upload unlawful, misleading, infringing or malicious material; or
- use the service in a way that causes us or another person to breach applicable law.
Availability, changes and suspension
We aim to provide a reliable service, but do not guarantee uninterrupted or error-free availability. Maintenance, provider outages, security events or circumstances beyond reasonable control may interrupt access.
We may change the service to improve security, reliability or functionality. We may suspend access where reasonably necessary to protect the service or others, respond to unlawful use, address non-payment or comply with law. Where practical, we will give notice and an opportunity to remedy the issue.
Our intellectual property
We and our licensors retain rights in the Stormwater Passport software, design, branding and documentation. These Terms grant you a limited, non-exclusive right to use the service while your account is authorised. They do not transfer ownership of the service or of customer data between the parties.
Liability and New Zealand law
Nothing in these Terms excludes or limits rights or remedies that cannot lawfully be excluded, including rights that may apply under New Zealand consumer law. The service is primarily offered for organisational and business infrastructure management. Any agreement to contract out of legislation for a transaction in trade must be express, in writing, fair and reasonable, and otherwise permitted by law.
To the maximum extent permitted by law, neither party is liable for indirect or consequential loss arising from use of the service. We are not responsible for decisions made from inaccurate customer-supplied information, failure to obtain professional advice, or unauthorised use that was not caused by our breach. This wording does not limit liability for fraud, wilful misconduct or any liability that law does not allow us to limit.
These Terms are governed by New Zealand law and New Zealand courts have non-exclusive jurisdiction.
Ending use of the service
You may stop using your account or cancel an organisation subscription through the available billing process. An organisation administrator may also end a member’s access. We may terminate an account for serious or repeated breach, subject to applicable law and reasonable process.
Termination ends the right to perform restricted actions but does not necessarily erase infrastructure history, audit records or information we must retain. Requests concerning account information and retained records are handled under our Privacy Policy.
Changes and contact
We may update these Terms as the service or law changes. We will publish the revised Terms with an updated date and provide additional notice where a change is material. Continued use after the effective date constitutes acceptance only to the extent permitted by law.
